Case Study
We were able to successfully represent a builder negotiate a resolution with the QBCC after proceedings were commenced by the Commission pursuant to section 111C(6) of the Queensland Building and Construction Commission Act 1991 (Qld).
Briefly, the background to the matter was that our client commenced a venture with another person in a building company. Our client never engaged in the venture and subsequently resigned as Director. The building company continued to operate but carried out some defective work after our client had resigned as Director.
Pursuant to section 111C(6) of the Queensland Building and Construction Commission Act 1995 a Director and a significant person can be personally liable for an amount paid out by the Commission under the insurance scheme as a result of the Company’s liability.
