We assisted a family who had entered into a contract to sell their home that included a special condition to rent back the property for a short period after settlement to allow them to find a new home.  Approximately one week after signing their sale contract the family found their new home and entered into a contract to purchase.  We were able to assist negotiate an amendment to the family’s sale contract to remove the rent back special condition.  We were also able to negotiate the settlement date of their purchase contract be brought forward so that both contracts settled on the same day.

Unfortunately, the seller’s bank was not ready to settle on the brought forward day and we were required to request early possession of the property otherwise our client’s would have had to find costly alternate accommodation whilst waiting for their purchase to settle.  The seller agreed to allow our clients early possession and the property settled the next week without any problems.
